Welcome to StudyIt. By downloading, accessing, or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By using StudyIt, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the app.
2. Description of Service
StudyIt is a mobile application that helps users create and study flashcards. Features include:
- Creating and organizing flashcard decks
- Scanning study materials using your camera
- AI-powered flashcard generation from your content
- Spaced repetition learning algorithms
- Progress tracking and statistics
3. Account Registration
To use certain features, you must create an account. You are responsible for:
- Providing accurate account information
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Subscriptions and Payments
StudyIt Pro Subscription
Free Trial: New subscribers receive a 3-day free trial. You may cancel at any time during the trial period at no cost.
Billing: After the trial period ends, you will be automatically charged the subscription fee. Subscriptions auto-renew until cancelled.
Plans Available:
- Monthly subscription
- Annual subscription (best value)
Important Subscription Information:
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
- Any unused portion of a free trial will be forfeited when you purchase a subscription
5. Refunds
All purchases are processed by Apple through the App Store. Refund requests must be submitted to Apple directly. We cannot process refunds for App Store purchases.
6. User-Generated Content
Your Content
You retain ownership of all study materials you create or upload to StudyIt, including flashcards, decks, and imported documents.
License Grant
By using StudyIt, you grant us a limited, non-exclusive license to:
- Store and process your content to provide the service
- Display your content back to you within the app
- Send your content to AI services for flashcard generation (when you use AI features)
Your Responsibilities
You are responsible for ensuring that content you upload:
- Does not violate any copyright, trademark, or other intellectual property rights
- Does not contain content you do not have the right to use
- Complies with all applicable laws and regulations
7. AI-Generated Content
When you use AI-powered features to generate flashcards:
- AI-generated content is created from materials you provide
- You may use generated flashcards for personal study purposes
- AI content may contain errors or inaccuracies - always verify important information
- StudyIt is not liable for any inaccuracies in AI-generated content
- You agree to OpenAI's usage policies when using AI features
8. Copyright and DMCA
Copyright Policy
You must not upload copyrighted materials without proper authorization. This includes textbooks, published materials, and other protected content unless you have the right to use them.
DMCA Takedown Requests
If you believe content in StudyIt infringes your copyright, please send a notice to support@studyitapp.com including:
- Description of the copyrighted work you claim has been infringed
- Description of where the infringing content is located in the app
- Your contact information (name, address, phone, email)
- A statement that you have a good faith belief the use is not authorized
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
We will investigate and remove infringing content as required by law.
9. Prohibited Content and Conduct
You agree NOT to create, upload, or share content that:
- Promotes violence, self-harm, or illegal activities
- Contains harassment, hate speech, or discriminatory content
- Is sexually explicit or pornographic
- Violates the privacy of others
- Contains spam, malware, or misleading information
- Impersonates another person or entity
- Infringes on intellectual property rights
10. Content Moderation
To maintain a safe environment:
- We use automated systems to detect prohibited content
- Content flagged by our systems may be blocked or removed
- You may report problematic content via Settings > Report Issue or by emailing support@studyitapp.com
- We reserve the right to remove content or suspend accounts that violate these Terms
- Repeated violations may result in permanent account termination
11. Intellectual Property
Our Intellectual Property
StudyIt and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws.
Trademarks
The StudyIt name, logo, and branding are our trademarks. You may not use our trademarks without written permission. Generated study content must not incorporate StudyIt branding.
Restrictions
You may not:
- Copy, modify, or distribute the app
- Reverse engineer or decompile the app
- Use the app for commercial purposes without permission
- Remove any copyright or proprietary notices
12. Educational Disclaimer
StudyIt is a study aid, not a substitute for professional education.
- We do not guarantee exam success or specific learning outcomes
- Educational effectiveness depends on individual effort and use
- AI-generated content may contain errors - verify important information
- Consult qualified professionals for academic or professional advice
13. Prohibited Uses
You agree not to:
- Use the app for any unlawful purpose
- Attempt to gain unauthorized access to any part of the app
- Interfere with or disrupt the app's functionality
- Use automated systems or bots to access the app
- Circumvent rate limits or usage restrictions
- Share your account credentials with others
14. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability for any claim arising from these Terms or your use of the app shall not exceed the amount you paid us in the 12 months preceding the claim.
16. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the app, your content, or your violation of these Terms.
17. Termination
We may terminate or suspend your access to the app immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:
- Your right to use the app ceases immediately
- You may lose access to your content stored in the cloud
- Content stored locally on your device remains accessible
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or via email. Continued use after changes constitutes acceptance of the updated Terms.
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
20. Dispute Resolution
Any disputes arising from these Terms or your use of the app shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits.
21. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
22. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and StudyIt regarding your use of the app.
